Terms and Conditions

Introduction

This purchase is regulated by the Standard Sales Conditions for Consumer Purchases of Goods over the Internet. Consumer purchases via the Internet are regulated primarily by the Contracts Act, the Consumer Purchases Act, the Marketing Control Act, the Cancellation Act and the E‑Commerce Act. These laws provide consumers with mandatory rights. The terms of the contract are not to be understood as a limitation on legal rights, but present the parties’ most important rights and duties in regard to the purchase.

The Sales Conditions have been created and are recommended by the Norwegian Consumer Authority.

1. Contract

The contract consists of these Sales Conditions, information provided in the ordering solution, and any specially agreed conditions. If there is a conflict, specially agreed conditions take precedence as long as they do not conflict with mandatory legislation. The contract is also supplemented by relevant statutory provisions regulating consumer purchases.

2. Parties

The seller is Sjølyst Innovations, Mårvegen 21A, 4347 Lye, Norway, sondresjoelyst@gmail.com, Org.nr. 934 531 035, and is referred to as the Seller.

The purchaser is the consumer who places the order, referred to as the Purchaser.

3. Price

The stated price includes all taxes and additional costs. The Purchaser shall not be charged for any additional costs that were not disclosed before the purchase.

4. Conclusion of Contract

The contract becomes binding when the Purchaser submits the order. A party is not bound if there are obvious typographical or technical errors in the offer or order that the other party realised or should have realised.

5. Payment

The Seller may charge the Purchaser from the time the goods are dispatched.

If paying by card, funds may be reserved at the time of ordering and charged when the goods are shipped.

If post‑delivery invoicing is offered, the invoice is issued upon dispatch and must have a due date at least 14 days after delivery. Purchasers under 18 cannot use post‑delivery invoicing.

6. Delivery

Delivery occurs when the Purchaser or their representative takes possession of the goods. If no delivery time is stated, delivery must occur within a reasonable time and no later than 30 days after the order unless otherwise agreed.

7. Product Risk

Product risk transfers to the Purchaser when the goods are received.

8. Right to Cancel (Angrerett)

Unless exempt, the Purchaser may cancel the purchase under the Cancellation Act.

The Purchaser must notify the Seller within 14 days after the cancellation period begins. Notice must be in writing (email is sufficient). The Purchaser bears the burden of proof that notice was given.

The cancellation period begins:

  • the day after the Purchaser receives the goods (for single items)
  • the day after the first delivery (for subscriptions or repeated deliveries)
  • the day after the final delivery (for multiple deliveries)

If the Seller has not provided information about the right to cancel and the standard cancellation form, the cancellation period is extended by up to 12 months. Once the information is provided, the period ends 14 days later.

When exercising the right to cancel, the goods must be returned within 14 days after notice is given. The Purchaser pays return shipping unless otherwise agreed. The Purchaser may inspect the goods but may be liable for any reduction in value caused by unnecessary handling.

The Seller must refund the purchase amount within 14 days after receiving notice of cancellation but may withhold the refund until the goods are returned or documentation of return is provided.

Include: name, order number, and a clear statement that you wish to cancel.

9. Delays and Non‑Delivery

If the Seller fails to deliver on time and this is not due to the Purchaser, the Purchaser may withhold payment, demand delivery, terminate the contract, and/or claim compensation under the Consumer Purchases Act. Claims should be made in writing.

10. Defective Goods

If the goods are defective, the Purchaser must notify the Seller within a reasonable time after discovering the defect. Notice within two months is always considered timely. The right to complain lasts two years (or five years for goods intended to last significantly longer).

The Purchaser may withhold payment, demand repair or replacement, request a price reduction, terminate the contract, and/or claim compensation. Notice must be given in writing.

11. Purchaser’s Breach of Contract

If the Purchaser does not pay or fulfill their obligations, the Seller may withhold the goods, demand payment, terminate the contract, and claim compensation. Interest and collection fees may apply according to law. A fee may be charged for uncollected, non‑prepaid goods, limited to the Seller’s actual costs.

12. Warranties

Any warranty provided by the Seller or manufacturer gives additional rights beyond statutory rights and does not limit the Purchaser’s rights under Sections 9 and 10.

13. Personal Data

The Seller is responsible for processing personal data. Only data necessary to fulfill the contract is collected unless the Purchaser consents otherwise. Data is only shared when necessary to fulfill the contract or when required by law.

14. Conflict Resolution

Claims must be directed to the Seller within a reasonable time. The parties shall attempt to resolve disputes amicably. If unsuccessful, the Purchaser may contact the Norwegian Consumer Authority for mediation at (+47) 23 400 600 or at https://www.forbrukertilsynet.no.
